These Terms of Use ("Terms") govern your use of the Time2Pack mobile application ("App") provided by Katsiaryna Huryna ("Company" or "We"). By accessing or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
1.1. You must be at least 13 years old to use the App. If you are under the age of 18, you represent that your legal guardian has reviewed and agrees to these Terms on your behalf.
1.2. By using the App, you represent and warrant that you have the right, authority, and capacity to enter into these Terms and abide by all of the provisions herein.
2. User Accounts
2.1. To use certain features or services of the App, you may be required to create a user account. You agree to provide accurate, current, and complete information during the registration process.
2.2. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3. App Content and Intellectual Property
3.1. The App and its content, including but not limited to text, graphics, images, logos, trademarks, and software, are owned by or licensed to the Company and are protected by intellectual property laws.
3.2. You may not modify, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any information, software, products, or services obtained from the App without prior written consent from the Company.
4. User Conduct
4.1. You agree to use the App only for lawful purposes and in accordance with these Terms.
4.2. You shall not:
a. Engage in any unauthorized or illegal use of the App.
b. Interfere with or disrupt the functionality or security of the App or its servers.
c. Upload, transmit, or distribute any material that is unlawful, harmful, defamatory, abusive, obscene, or otherwise objectionable.
d. Attempt to gain unauthorized access to any portion of the App, other user accounts, or any other systems or networks connected to the App.
e. Use any automated means or interfaces to access the App or extract data from it.
5. In-App Subscriptions
5.1. The App may offer subscription-based services. By subscribing to these services, you agree to pay the applicable fees and abide by the terms and conditions associated with the specific subscription plan.
5.2. Subscription details, including pricing, duration, and cancellation policies, will be provided within the App before you make a purchase. You acknowledge and agree to these terms before initiating a subscription.
5.3. The available Subscription options may include, but are not limited to:
a. Monthly Subscription: This Subscription plan renews automatically on a monthly basis unless canceled by the user.
b. Six-month Subscription: This Subscription plan renews automatically every six months unless canceled by the user.
c. Annual Subscription: This Subscription plan renews automatically on an annual basis unless canceled by the user.
5.4. You understand and acknowledge that Subscriptions are non-refundable, and no refunds or credits will be provided for partially used periods or unused Subscriptions.
5.5. The Company reserves the right to modify, add, or remove Subscription options and associated terms at any time without prior notice.
6. Privacy
6.1. We respect your privacy and handle your personal information in accordance with our Privacy Policy, which is incorporated by reference into these Terms. By using the App, you consent to the collection, use, and sharing of your personal information as described in the Privacy Policy.
7. Termination
7.1. We may, at our sole discretion, suspend or terminate your access to the App at any time, without notice or liability, for any reason, including if we believe you have violated these Terms.
7.2. Upon termination, all provisions of these Terms that by their nature should survive termination will continue to apply, including but not limited to ownership provisions, warranty disclaimers, and limitations of liability.
8. Disclaimer of Warranties
8.1. The App is provided on an "as is" and "as available" basis, without warranties of any kind, either expressed or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
8.2. We do not warrant that the App will be error-free, uninterrupted, secure, or free from viruses or other harmful components. Your use of the App is at your own risk.
9. Limitation of Liability
9.1. To the fullest extent permitted by applicable law, the Company, its affiliates, officers, directors, employees, agents, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the App.
9.2. In no event shall the total liability of the Company exceed the amount you have paid, if any, to access or use the App.
10. Amendments to the Terms
10.1. We reserve the right to modify or replace these Terms at any time, without prior notice. Any changes to the Terms will be effective immediately upon posting the updated Terms on the App.
10.2. By continuing to access or use the App after the updated Terms have been posted, you agree to be bound by the revised Terms.
11. Governing Law and Jurisdiction
11.1. These Terms shall be governed by and construed in accordance with the laws of Belarus, without regard to its conflict of law provisions.
11.2. Any dispute arising out of or relating to these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in Belarus.
12. Severability
12.1. If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
13. Entire Agreement
13.1. These Terms constitute the entire agreement between you and the Company regarding the use of the App and supersede any prior or contemporaneous understandings or agreements.
